Terms of Use

This agreement (hereinafter the “Agreement” between Bartell & Bartell, Ltd. (hereinafter B&B) and you sets forth the terms and conditions which govern your use of any of the products and services related to interview questions, on-line instruments, assessment profiles or any other services or products purchased from B&B.
 
PLEASE READ THIS AGREEMENT CAREFULLY BEFORE PURCHASING ANY OF OUR PRODUCTS.  BY ACCEPTING THIS AGREEMENT YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS SET FORTH BELOW.  ADDITIONALLY YOU ARE REPRESENTING THAT YOU ARE AN AUTHORIZED REPRESENATIVE OF THE BUSINESS OR ORGANIZATION MAKING THIS PURCHASE AND THAT YOU HAVE THE AUTHORITY TO ENTER INTO AND ENFORCE THE TERMS OF THIS AGREEMENT WITHIN YOUR COMPANY OR ORGANIZATION.  IF YOU DO NOT AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS YOU MAY NOT PURCHASE OR ACCESS OUR PRODUCTS OR ON-LINE SERVICES.
B&B MAY MODIFY THIS AGREEMENT AT ANYTIME, AND SUCH MODIFICATIONS SHALL BE EFFECTIVE IMMEDIATELY UPON NOTICE, WHICH MAY BE ACCOMPLISHED BY CHANGING THE AGREEMENT THE NEXT TIME YOU PURCHASE ANY OF OUR PRODUCTS OR SERVICES.  YOUR USE OF AND PURCHASE OF OUR PRODUCTS SHALL BE DEEMED YOUR ACCEPTANCE OF SUCH CHANGES.  YOU AGREE TO REVIEW THE TERMS OF THE AGREEMENT PERIODICALLY TO BE AWARE OF SUCH MODIFICATIONS.  IF WE REQUEST IT, YOU WILL IRREVOCABLY AGREE TO SIGN A NON-ELECTRONIC VERSION OF THIS AGREEMENT.
 
By agreeing to these terms, you agree that:
 
  1. You will not use our products or services in any way other than the stated purpose of the product or service. Specifically you agree that you will not use our products or services for the purpose of taking adverse action against an individual or employee, including but not limited to, termination, demotion, or disciplinary or discriminatory action.
  2. If you are using any of our services or products as a tool for selection or promotion you agree that any decisions made as a result of using these products, or additional information you obtain in relationship to these products, are the sole responsibility of the company or agency making the hiring and promotion decision. You agree that if any lawsuit, legal action or claim or complaint is made in relation to the selection or promotion process, or from subsequent decisions made or actions taken by you or your company or organization, that you and your company or organization will indemnify and reimburse any costs or expense to Bartell & Bartell, Ltd., its officers, employees, and representatives.
  3. You agree that any decisions made or action taken by you, your agent or employee as a result of the use of the information provided as a result of using our products and services are yours alone and can not be attributed to Bartell & Bartell, Ltd.
  4. Any ID codes and passwords issued to you are your complete responsibility to monitor and distribute. B&B can not control the process you use to assign the ID codes and passwords and it is your complete responsibility to guarantee the security of these identities.
  5. You will not impersonate any person or identity or falsely misrepresent your affiliation with a company, organization, or entity.
  6. You will not or allow others to: copy, sell, give away, reverse engineer, reverse assemble, or otherwise attempt to discover the code, distribute, transmit, display, perform, reproduce, publish, license, otherwise provide, create derivative works from any of the information, software, products or services obtained through our website.
  7. You will not resell our products, ID or passwords, to any other party or entity without our written permission to do so.
  8. You will not duplicate, copy, or use our questions, or results to develop any other product or service for sale or use by you or others.
